KITA Terms of Service

1. Agreement to these terms

These Terms of Service govern your use of the KITA app and website and any related services ("KITA", "the service", "we", "us", "our"). KITA is operated by B4U SRL, registered at VIA SPAGNA 1, 65015 MONTESILVANO, ITALY.

By creating an account or using the service, you agree to these terms and to our Privacy Policy. If you do not agree, you must not use KITA.


2. Who can use KITA

You may use KITA only if you are at least 18 years old, or older where your local law sets a higher age. You must have the legal capacity to enter into this agreement. You must not be barred from using the service under any applicable law, and you must not have been removed from KITA for a breach of these terms.

By using KITA you confirm that you meet these requirements. We may ask you to confirm your age and identity at any time.


3. Your account and identity verification

You must provide accurate information when you register and keep it up to date. You are responsible for your account and for keeping your login secure. You must not share your account, impersonate anyone, or create a profile for someone other than yourself.

KITA requires identity verification to protect the community. You must complete at least the selfie verification before you can send messages. You agree that the information and images you submit for verification are genuine and belong to you. Submitting false verification data is a serious breach of these terms and may lead to removal.


4. How you must behave on KITA

KITA exists so that real, respectful adults can meet. You agree to use the service honestly and to treat other people with respect. The following conduct is not allowed, and the list is examples rather than a complete account.

If you encounter any of this behaviour, you can report and block the person inside the app, and we encourage you to do so.


5. Your content and the licence you give us

You keep ownership of the photos, text and other content you add to KITA. To run the service we need permission to use that content, so you grant KITA a worldwide, non exclusive, royalty free licence to host, store, display and adapt your content for the purpose of operating and promoting the service, in line with our Privacy Policy. This licence ends when you delete the content or your account, except for copies we must keep for a short time to meet legal duties or to enforce these terms.

You are responsible for the content you share, and you confirm that you have the right to share it and that it does not break any law or these terms.


6. Meeting people and your safety

KITA helps you meet people, but you alone decide who to talk to and who to meet, and you do so at your own risk. This section matters, so please read it.

KITA is not a background checking service. Verification confirms that a person is real and matches their photos, and, at the higher levels, confirms their identity, but it does not guarantee that a person is trustworthy, lawful or safe, and it is not a criminal record check unless we expressly say otherwise. We do not vouch for the conduct of any user, online or in person.

You are responsible for taking sensible precautions when you talk to or meet other users. Meet in public places, tell someone where you are going, and stop any interaction that makes you uncomfortable. To the extent the law allows, KITA is not responsible for the conduct of any user or for anything that happens during or after a meeting arranged through the service.


7. KITA Premium and payments

KITA is free to use for its core features. We also offer paid features through a subscription called KITA Premium.

Subscriptions are sold and billed through the Apple App Store and the Google Play Store, under the account you use with those stores. Prices are shown in the app before you buy. Subscriptions renew automatically for the same period unless you cancel before the renewal date, and you manage and cancel them through your store account settings, not through KITA directly.

Refunds are handled by the store under its own rules, and we do not control them. Where the law gives you a right to cancel or to a refund, that right continues to apply.


8. Our intellectual property

The KITA name, the sampaguita petal mark, the design of the app, and the software behind it belong to KITA and are protected by law. We give you a personal, limited, non transferable right to use the app for its intended purpose. You must not copy, sell, or build on the KITA brand or software, and you must not remove or alter any notice of ownership.


9. Moderation, suspension and removal

We moderate the service to keep it safe. We may review profiles, hold back photos until they are approved, and act on reports.

We may suspend or remove your account, with notice where reasonable, if you break these terms, if your conduct puts other users or KITA at risk, or if we are required to do so by law. Where the breach is serious, for example anything that endangers a minor or another person's safety, we may act immediately and without notice.

You may delete your account at any time through the app. When you do, we handle your data as set out in the Privacy Policy.


10. Disclaimers

We work hard to provide a good service, but we provide KITA as it is and as available. To the extent the law allows, we do not promise that the service will be uninterrupted, error free, or that it will lead to any match, conversation, relationship or outcome. We do not guarantee the identity, conduct or intentions of any user beyond the verification signals described in these terms and in the Privacy Policy.


11. Limitation of liability

To the fullest extent allowed by the applicable law, KITA and the people who work for it are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profit or reputation, arising from your use of the service or your interactions with other users. Nothing in these terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by negligence or for fraud.

Where liability cannot be excluded but can be limited, our total liability to you is limited to the amount you paid us in the twelve months before the event that gave rise to the claim, or, if you paid nothing, to a reasonable amount set by the applicable law.


12. Indemnity

To the extent the law allows, you agree to cover KITA against claims, losses and reasonable costs that arise from your breach of these terms, your misuse of the service, or your infringement of the rights of another person.


13. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines. You and KITA agree that the courts of the Philippines have jurisdiction over any dispute arising from these terms or the service, without prejudice to any mandatory right you may have to bring proceedings, or to be sued, in the country where you live.

Before starting formal proceedings, we encourage you to contact us so that we can try to resolve the matter directly.


14. Changes to these terms

We may update these terms as the service and the law change. When we make a material change, we will tell you in the app or by email before it takes effect. If you continue to use KITA after a change takes effect, you accept the updated terms. The date at the top shows when the terms were last revised.
